These Terms of Service govern your use of bitaxedeploy.com and any purchase you make from it. Please read them before ordering. By placing an order you confirm that you accept these terms.

In these terms, “we”, “us” and “BitaxeDeploy” mean BitaxeDeploy, 7370 N 77th St, Omaha, NE 68122, United States. “You” means the person placing the order.

1. Who may buy from us

You must be at least 18 years old and legally able to enter a contract. By ordering you confirm that you meet both conditions, that the payment method is yours or that you are authorised to use it, and that the information you give us is accurate.

We sell to customers in the United States only. You are responsible for ensuring that owning and operating the hardware you buy is lawful where you intend to use it, including compliance with local electrical codes, noise ordinances, tenancy or HOA restrictions, and any applicable rules on cryptocurrency-related activity.

2. What we sell

We sell physical computing hardware and related accessories: ASIC mining machines, DePIN network devices, power accessories, maintenance tools and firmware. We also list certain service items such as diagnostics and extended cover.

We are a hardware retailer. We do not operate a mining pool, custody or exchange cryptocurrency, provide investment or financial advice, sell securities or investment contracts, offer hosting or managed mining, or guarantee any output, yield or return from any device. 3. Product information and accuracy

We describe products as accurately as we can, using manufacturer specifications alongside our own testing where we have it. Specifications such as hashrate, power draw, efficiency and noise are manufacturer figures measured at factory settings. Real-world results vary with firmware version, configuration, ambient temperature, supply voltage, altitude and the condition of the unit. Where we quote a figure as approximate or as a range, treat it as such.

Product images are representative. Minor variation in finish, revision, bundled cabling or connector type can occur between production batches. Where a difference is material we state it on the product page.

Despite our efforts, listings may occasionally contain errors in description, specification, availability or price. We reserve the right to correct errors at any time, including after an order has been submitted.

4. Pricing

Prices are in US dollars and exclude shipping and applicable sales tax, both of which are calculated and displayed at the checkout before you pay. Prices may change at any time before you place an order; the price that applies to your order is the one shown at the moment you complete checkout.

If a product is listed at a materially incorrect price because of a clerical or technical error, we are not obliged to supply it at that price. We will contact you, and you may either confirm the order at the corrected price or cancel it for a full refund.

5. Orders and acceptance

Your order is an offer to buy. Our order confirmation email acknowledges receipt but does not constitute acceptance. The contract is formed when we dispatch the goods. Until then we may decline or cancel an order, refunding any payment in full.

We may decline or cancel an order where:

  • The item is unavailable or was listed in error;
  • The price or description was materially incorrect;
  • We cannot verify the payment method, the billing details or the delivery address;
  • The order appears fraudulent, or is for resale in volumes we have not agreed;
  • The delivery address is a freight forwarder or outside the United States;
  • Supplying would breach applicable law or sanctions.

We may also limit quantities per customer or per order, particularly on launch batches and promotional items.

6. Payment

Payment is taken at checkout through Shopify Payments and the accelerated wallets offered there. We accept major credit and debit cards and the digital wallets shown at checkout. Card details are handled by our PCI-DSS compliant payment processor and are never stored on our systems.

If a payment is reversed, charged back or fails after dispatch, you remain liable for the goods and the shipping cost. We will contact you before pursuing any further step.

7. Shipping, returns and warranty

Delivery is governed by our Shipping Policy, returns and refunds by our Refund Policy, and hardware faults by our Limited Warranty. Each of those documents forms part of these terms.

Risk of loss and damage passes to you on delivery. Title passes when we have received payment in full.

8. Using the hardware safely

Mining and DePIN hardware is specialised equipment for experienced and enthusiast users. By purchasing you acknowledge that:

  • It draws significant continuous power and must be connected to a circuit rated for that load;
  • It generates continuous heat and requires unobstructed ventilation;
  • It can be audible, in some cases substantially so;
  • It is not a household appliance and is not intended for use by or around children;
  • Installation may be subject to local electrical codes, and electrical work should be done by a qualified electrician.

9. Firmware, third-party software and networks

Some products ship with, or can run, third-party or open-source firmware. That software is supplied under its own licence terms by its own authors, and we are not its author. Installing alternative firmware, or operating hardware outside manufacturer-published limits, may affect your warranty — see the Warranty page.

DePIN devices connect to independent third-party networks (for example Helium, WeatherXM, GEODNET, Wingbits and 4DSKY). Those networks set their own rules, reward structures and eligibility criteria, and may change or discontinue them at any time. We do not control any of them and make no commitment about what any network will or will not provide.

10. Intellectual property

All content on this site — text, product descriptions, photography, graphics, layout and code — is owned by BitaxeDeploy or used under licence, and is protected by copyright and other intellectual property law. You may not copy, reproduce, scrape or republish it without our written permission.

Third-party product names, logos and trade marks are the property of their respective owners and appear here for identification only. Their use does not imply endorsement or affiliation unless stated.

11. Acceptable use

You agree not to use this site to break the law, interfere with its operation or security, scrape or harvest data by automated means, submit false or fraudulent orders, or infringe anyone's rights.

12. Disclaimers

Except where these terms, our warranty or applicable law provide otherwise, the site and products are supplied “as is” and we disclaim all other warranties to the fullest extent the law permits, including implied warranties of merchantability and fitness for a particular purpose.

We do not warrant that the site will be uninterrupted or error-free, nor that any product will achieve any particular hashrate, efficiency, uptime, network reward or financial outcome.

13. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to any order is limited to the amount you paid for the product concerned.

We are not liable for indirect, incidental, special, consequential or punitive losses, including lost profits, lost revenue, lost cryptocurrency or network rewards, lost data, electricity costs, downtime, or loss of opportunity, even if we were advised such losses were possible.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

14. Indemnity

You agree to indemnify BitaxeDeploy against claims, losses and reasonable costs arising from your breach of these terms, your misuse of a product, or your failure to comply with laws and regulations applicable to its installation or operation.

15. Force majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural events, war, civil unrest, epidemic, strike, carrier failure, utility or network outage, component shortage, manufacturer delay, or change in law.

16. Privacy

Personal information is handled as described in our Privacy Policy.

17. Changes to these terms

We may update these terms from time to time. The version in force is the one published on this page at the moment you place your order, and the date at the top shows when it last changed. Changes are not retroactive.

18. Governing law and disputes

These terms are governed by the laws of the State of Nebraska and applicable federal law of the United States, without regard to conflict-of-laws principles. The state and federal courts located in Nebraska have jurisdiction, and you consent to that venue. This does not deprive you of the protection of mandatory consumer law in your state of residence.

Before starting formal proceedings, please contact us — most issues are resolved quickly by email.

19. General

If any provision is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the policies referenced in them, are the entire agreement between us regarding your order.
